Introduction
These Terms of Purchase set out how you (the User) can make purchases from our Site and associated Thrivecart site. Please read them carefully. We pride ourselves in providing a high level of customer service and ensuring that you are clear in respect of all of your rights relating to your purchase. Ahead of making any purchase you will be asked to tick a box which says “I agree to the Terms and Conditions”. In ticking that box, you will be accepting the terms set out here.
We are based in the UK and our Terms of Purchase are governed by UK legislation. Our digital documents and courses can be downloaded worldwide.

Purchase Terms
We are proud of The Freedom CEO Society and resources, and the results which our clients achieve from them. If you purchase a Membership, you are purchasing a digital membership subscription on the ThriveCart platform, and will receive access details via email automatically once your payment has been processed.
Upon execution of this Agreement, electronically, verbally, or otherwise, Abby McKendry, also known as Abbsolute Studio ("Service Provider") agrees to provide services in accordance with The Freedom CEO Society (“Membership”). The scope of services rendered by Abby McKendry/Abbsolute Studio pursuant to this contract shall be solely limited to those contained therein and/or provided for on our website as part of the Membership, including: masterclasses which will be recorded, customisable templates, downloadable workbooks and access to a private Facebook group. All services rendered will be throughout the duration of member’s enrollment in the The Freedom CEO Society.
Office Hours: The Member acknowledges that with the scheduled monthly office hour calls, given all time-zones around the world, not all group calls are guaranteed to be within all Member's waking hours. It is the Member’s responsibility to attend the meetings at the scheduled time. The Member shall not receive any refund, partial or otherwise, if they are unable to attend some or all of the office hours.
You understand and agree that Abbsolute Studio and The Freedom CEO Society services and deliverables are limited to the Scope detailed in this Agreement. Abbsolute Studio reserves the right to substitute services equal to or comparable to the Membership for Members if it is reasonably required by the prevailing circumstances.
Please be advised that we reserve all rights to our intellectual property for both our customised and non-customised products and services. Abby McKendry/Abbsolute Studio grants you a single-use non-transferable license and access to The Freedom CEO Society This means that whilst you are free to use, download digitally, or print out a copy for personal use, you are not permitted to copy, distribute, adapt, edit or share any of our products with third parties. You may not share your login credentials for the The Freedom CEO Society with any third party for any reason, you may not sell or transfer your access to the The Freedom CEO Society

Payment
Upon execution of this Agreement, Member agrees to pay Service Provider the full purchase amount for the product, regardless of what payment option Member selects at checkout. If Member selects a payment plan option, Member authorises charge of the card or account used at checkout to complete all payments pursuant to the payment plan. Service Provider and The Freedom CEO Society reserves the right to collect any and all monies owed by Member to Company for the Membership, by any means necessary within the parameters of the law. The Member shall pay for any fees associated with recouping payment, including but not limited to, collections fees and legal fees.
Due to the nature of this digital membership, and as you receive access right away, you will not be entitled to receive a refund for the months you have purchased, so do check that you are purchasing the correct product or service to meet your needs. Your other statutory rights to a refund remain in place in the usual way. You can cancel further subscription payments at any time, and will not be charged for any future membership payments, which will result in the loss of access to The Freedom CEO Society platform and materials.
Service Provider and The Freedom CEO Society will have the right to limit Your access and remove You from the Membership if payments are not made as outlined in this agreement. Failed payments and contested charged will be sent to a collection agency.
Earnings Disclaimer
You understand and agree that this website and our products, programs, and services are intended to provide information and education to assist you in attaining your goals. You understand and agree that your success depends entirely on your business experience, motivation, and individual capacity. There are no guarantees of any kind as to your earnings and income.
Abby McKendry/Abbsolute Studio is an independent contractor and shall not be considered an employee of You. Nothing contained in this Agreement shall be construed to create any relationship of employer and employee, agent and principal, partnership or joint venture between the Parties. You understand that Company is an independent contractor and shall remain free to enter into additional contracts and provide services and Memberships to others.
No-Professional Member Relationship
The information contained in this Membership is provided on an “as is” basis. Service Provider and The Freedom CEO Society makes no representations or warranties, express or implied, with respect to the content provided in this Membership or on any third-party website which may be accessed by a link from inside the Membership, including any representations or warranties as to accuracy, timeliness, or completeness. Company will not be liable or held responsible for any losses, injuries, or damages from the display, use, or reliance on any of the information contained in this Membership.
Pricing
The prices are as quoted on the website for each item.
We may change our prices at any time but changes will not affect any order in respect of which we have already sent you an order confirmation.
It is always possible, despite our best efforts, that some products listed on our Site may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that, where a product's correct price is less than our stated price, we will charge you the lower amount when dispatching the product to you. If a product's correct price is higher than the price stated on our Site, we will contact you to inform you of the error and give you the option of either continuing your purchase of the product at the correct price or cancelling your order. If we are unable to contact you using the details you provided during the order process, we will treat your order as having been cancelled and notify you in writing. We are under no obligation to provide any product to you at an incorrect (lower) price if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.

Non-disclosure
Parties promise and agree to:
Secure and protect the other Party’s Confidential Information,
Hold Confidential Information in strict confidence,
Use Confidential Information only for purposes of carrying out each Party’s obligations under this Agreement,
Refrain from using, disclosing, selling, licensing, publishing, reproducing, or otherwise making available the Confidential Information of the other party except to the extent necessary to perform the Services under this Agreement,
Only disclose Confidential Information to those of the Party’s officers, employees, and agents as are necessary to carry out the purpose of this Agreement; and
Not disclose Confidential Information to unnecessary third parties.
For purposes of this Agreement, Confidential Information includes, but is not limited to: Company created courses, any plan or documents used by Company in the course of the Coach-Member relationship, past, present, or future products, product or service information, pending projects/proposals, creative works, business plans, marketing strategies, customer lists, business records, financial information, and any other information designated as confidential by the Parties.
Information is not confidential if it is generally available or known within the internet industry, it is in the public domain, it was known to either party before this Agreement was entered into, it was independently received by either party from a third party, or it was developed independently by the Company or Member.
Warranty and Liability
The information provided on abbymckendry.com and Thrivecart.com/AbbsoluteStudio is believed accurate when made. However, we do not warrant or represent that such information is or will always be current, accurate, and/or complete.
By purchasing this product, Member accepts any and all risks, foreseeable or unforeseeable, arising from such transaction. Member agrees that Service Provider or The Freedom CEO Society will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the Company’s products or services. Member agrees that use of this Membership is at user’s own risk.
You agree that we are not responsible for the accuracy of our website or for any errors or omissions in its content or in our products and/or services purchased therefrom or via materials requested through email.
We do not exclude or limit in any way our liability:
For death or personal injury caused by our negligence;
Under section 2(3) of the Consumer Protection Act 1987;
For breach of the terms implied by sections 12 to 15 of the Sale of Goods Act 1979;
For fraud or fraudulent misrepresentation; or
For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
We only supply products for domestic and private use and you agree not to use any products for commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity. You agree that Abby McKendry or Service Provider is not liable for any loss incurred by you or your business, including, but not limited to, loss of clients, loss of goodwill, loss of income or revenue, loss of anticipated income, loss of sales, loss of data, computer failure, computer virus obtained by use of our website or its content, or products and/or services purchased therefrom, or via materials requested through email, or any other similar issue, or any other loss or damage of any kind.
Additional Circumstances
Should you consider that you have grounds to obtain a refund which are not set out above you should email abby@abbymckendry.com set out your refund request. All refunds are provided in accordance with your statutory rights.
Law and Jurisdiction
These terms and any claim or dispute arising in relation to any purchase will be governed by English law. You and we agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any such claim or dispute.
We may change, modify, or update these Terms and Conditions at any time and will notify you of any such changes by a prominent notice displayed on our website at least 10 days prior to implementing the change. We recommend that you check the Terms and Conditions when you visit our website to be sure that you are aware of our most current policies
